my DLA has been taken away based on ESA medical Options

My DLA care and mobility (previously middle care and higher mobility) have been withdrawn with immediate effect following my medical assessment for ESA, despite the fact that I am appealing. Means another appeal and potentially ANOTHER tribunal. I can ask motability if I can keep the car until the appeal/tribunal is held, but THERE ARE NO GUARANTEES.
Based on that dratted doctor's report, I have lost ALL benefits.
Appeal forms are in the post to me.
I am too upset to ring Motability today.
I am devastated.

Jan, what can we say? Its unbelievable!!! so one minute you are disabled, and the next you are fine and need no help with mobility or care. Amazing that, maybe we should all get this magical cure then!!! I am so sick for you, and very angry!!! how dare they do this, they have no idea how much devastation they cause, and seem to care even lessSad

Unfortunately, I think it is only too believable!! Their aim is obviously to stop paying out any benefit at all. Jan, as well as your appeal I think you should complain to your local MP. I believe this situation will happen to everyone of us. You won't be alone!

they take the money away but if you had to go to a job just to survive they wouldnt give you job beacause youre still ill and to top that, beacause you dont get help they dont help you into work beacause youre not entiled cause youre not able to claim i now ive been there my husband works so im penalised .ive got to fill form in for vo;entary work for 2 hours frightend it will mess my esa up we should do a letter petion agin on this subject before election quick

Crikey, this is getting scarey!

Its not fair on disabled people that an ATOS employee, or whoever they are, with no medical qualifications can be allowed to assess someone's health and ability to work by asking questions on a computer programme and then, depending on their unqualified opinion, turn round and override all the medical evidence given to the DWP for your DLA claim. Surely this is discrimination against disabled people, we are being treated less favourably because of our disabilities and not given a fair hearing? At this rate, we'll all be turned down and benefits taken away......... see you all in the Workhouse!

I have spoken to Motability. I was barely able to speak because I am so upset. They were very understanding and I can keep my car whilst I appeal, up to 6 months. If the appeal fails, I can use the deposit paid up front towards the retrospecive cost of the hire.
I feel completely defeated and keep bursting into tears. I will appeal and fight it to the end. I also intend to meet with my MP, who is very good and caring. But I cannot do anything today, I'm just too upset. Also, my cat is obviously deteriorating every day, another devastation.

Jan, Just to let you know I BELIEVE YOU and I WILL LISTEN!

Please email your local advocacy service who will do all the fighting for you, also leave a message for the rheummy nurse and ask for the hospital SW to be in touch and support you having your social health needs properly assessed and addressed.

The joy of email is not actually having to speak to anyone.

This happened once to me with the motability- someone shopped me to the benefit fraud line and they filmed me secretly and took all my benefit- they filmed me the wk I had just had a depomedrone injection (many yrs ago now) and although I was clearly limping I managed to get a bag of tesco food into the boot of my car. I lost my benefit that day.

I couldnt appeal as I was out of time when I found out.

so I reapplied for the DLA and got it reinstated.

Hi Jan,

Well, I'm absolutely disgusted! I thought DLA was non means tested and independent from other benefits, so what are the DWP playing at? There are many people who are in work and entitled to DLA, is the DWP now saying that you can only get DLA if you are unable to work and receive ESA?

So sorry to hear this Jan. Finding it very hard to take it in as it all seems so completely unrealistic. The payment of DLA is totally separate from other benefits and the criteria for receiving one does not impact on the others, well at least it didn't used to!! Is there some mistake here? Surely?

Sorry your cat isn't making progress towards a recovery. Is the meloxicam not working?

Again, thanks for the support.
My beloved cat seems to be fading fast..... devastated.
The DWP oversees all of this. The government wants to get as many people off benefits as possible each month. Draw your own conclusions.
I have visitors from Australia for the next 3-4 days and have to concentrate on them because they were so good to my daughter last year.
THEN, I will find the best way to FIGHT.
OUTRAGEOUS... if my circumstances were different, this would have tipped me over the edge... I dread to think!

You are right to focus on that first and then set your mind to the task of sorting out this injustice!
